The opportunity

The Senior Director, Associate General Counsel, Market Access and Pricing role reports directly to the SVP, General Counsel, US Commercial and TGO. This position is responsible for advising the Company on the pricing, reimbursement, and access of our products in the U.S., as well as providing legal support to Government Affairs and Payor Marketing.

 

This role partners principally with Government Price Reporting, Finance, Market Access, Government Affairs, and Compliance and Ethics and others in the Legal Department, to provide legal support and training essential to their respective short- and long-term business functions and address, plan for, and/or resolve various and complex issues.

 

Location: This is a hybrid role based in Parsippany, NJ.

How you’ll spend your day

  • Serve as lead counsel for the Government Price Reporting function, including advising on compliance with government price laws, including state drug price reporting requirements; drafting reasonable assumption documentation and policies; providing guidance on and interpretation of regulations and laws; and assisting in pricing restatements, disclosures and investigations.
  • Support the Government Affairs function by analyzing impact of prospective laws and developing lobbying strategy; and engaging, as needed, with government and regulatory agencies to educate on the implications of specific policies and laws.
  • Provide guidance on state pricing transparency and other pricing related laws.
  • Provide guidance on the Inflation Reduction Act and other federal laws.
  • Serve on various internal pricing committees.
  • Provide strategic legal counsel to Payor Marketing and Market Access on reimbursement and access matters .
  • Manage outside counsel who provide services in support of this role.
  • Provide trainings to management and employees on emerging and/or hot legal topics.
  • Keep abreast of changes in law that affect supported client areas.

Your experience and qualifications

  • A Juris Doctor (JD) degree from a top tier law school is required.
  • Minimum 15 years prior experience at law firm and/or in-house legal department.
  • Admission to practice law in the state of New Jersey or ability to obtain an in-house limited license.
  • Pharmaceutical experience, either working in-house or supporting through private practice, is required.
  • Strong proficiency in government price reporting including AMP, ASP, Best Price, Federal Supply Schedule, and 340B as well as extensive knowledge of government healthcare programs (e.g., Medicaid, Medicare, Tricare, VA, etc.).
  • Deep understanding of healthcare-related laws including Anti-Kickback Statute and False Claims Act.
  • Experience with competition, pricing, reimbursement, and access issues as they pertain to the pharmaceutical industry.
  • Strong relationship-building skills, able to influence internal and external stakeholders. This individual will be highly visible at all levels of the organization and must be able to build trust and credibility.
  • Strong written and communication skills, including presentation skills.
  • Strong business and financial acumen.
  • Good judgement and a meticulous level of attention to detail.
  • Proactive and collaborative, working with key stakeholders internally and externally.
  • Techniques to work effectively under pressure, meet deadlines, and adjust to changing priorities.
  • Substantive experience in Word, Excel, and PowerPoint
  • Limited travel
