Job Description

The purpose of the position is to deliver accurate and timely legal counsel and services to the Market Access department of the Teva North America business under the direction of the General Counsel, North American Commercial & Generics.  The attorney in this role is responsible for meeting the legal needs of the Market Access group, including PBM and payer rebate and discount agreement negotiation and drafting, counseling on federal and state price reporting and fraud and abuse questions, and other legal and regulatory issues affecting the managed markets agreement and formulary work.  The position helps ensure that the company complies with applicable laws, rules and regulations affecting the business unit.  The attorney occupying this role is responsible for the drafting of payer agreements entered into by the Markets Access group, and other commercial contracts affecting both the specialty and generics business segments. A general understanding of the relationship and differences between generic and branded pharmaceutical value propositions will be helpful to the successful candidate; experience with biologic and biosimilar products will be useful in the role.

Essential Duties & Responsibilities           

  • Delivers timely, competent legal services in support of the Market Access group, such as agreement drafting and legal counseling on related issues.  
  • Participates in Market Access field meetings and trains on issues related to rebate contracting, formulary placement and payer agreements.          
  • Assists as needed in audits of customer utilization and compliance with rebate agreements.        
  • Ensures that the company is in compliance with all applicable laws, rules and regulations; monitors compliance and makes recommendations to the General
  • Counsel regarding changes to policies or operations.      
  • Participates in the strategic planning process and in the development of department business plans.       
  • Gives final legal approval for agreements entered into by the company. 
  • Follows Teva Safety, Health, and Environmental policies and procedures.              
  • Other projects and duties as required/assigned.

Job-specific Competencies

Agreement Drafting:

  • Experience in all aspects of drafting contracts, specifically pharmaceutical payer rebate and discount agreements.

Negotiation:

  • Experience in counseling and assisting clients in the negotiation of agreements, including participating in the negotiation process.

Understanding of Managed Markets

  • Good working understanding of the managed markets/payer industry, including PBMs, government payers, formulary placement and fraud and abuse standards related to the payer industry.

Qualifications

Required:

  • JD Degree.
  • 8 years in a law firm and/or in-house legal department.

Preferred:

  • 4 years in a large law firm plus legal experience in the branded       pharmaceutical industry or managed markets/payers industry, such as pharmacy benefit managers.
  • JD Degree and undergraduate or graduate coursework or degree in business or work experience aligned with sales and selling organizations.

Specialized or Technical Knowledge Licenses, Certifications needed:        

  • Active license to practice law in at least one US state, with ability to secure limited in-house counsel license from State of New Jersey

Company/Industry Related Knowledge:

  • Knowledge of the managed markets/payer industry, such as PBMs, rebate agreements, specialty pharmacies and related payer groups, as well as Medicare Part D, Tricare and other government programs.
